We offer the finest quality art every time. We limit advertising, no annoying and constant Email campaigns. To provide the best service, we receive, collect, and store any information that only you enter on our website, through your membership subscription or interactive connectivity. In addition, by subscription you offer our permission to collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. For purposes of our marketing services or merchant transactions we may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. 2. PRICING

When buying an item, you agree that:
(i) you are responsible for reading the full item listing before making a commitment to buy it
(ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. The information on pricing and description will be shown on the payments page.
3. PAYMENT OPTIONS

We accept credit cards, debit cards, and most major payment methods for your convenience.
For flexible purchasing, we offer payment plans through PayPal’s Pay in 4 program. This option allows you to split your total into four interest-free payments over six weeks, with no late fees or sign-up costs2.
If Pay in 4 isn’t available for your purchase or location, you’re welcome to request a custom Price Quote from Atsaq.Art.

​4. 3D ART FULFILLMENT
​
Pre-Order NOTICE: Individual pre-orders for framed 3D artwork in sizes 8"x10" and 11"x14" will ship within 3 business days. For larger 16"x20" frames, please allow up to 4 business days for processing.
Holiday Reminder: December is our busiest season—please add 3 extra business days to estimated shipping times.

Advance Notice for Corporate or Tribal Award Orders: To ensure availability of all required shadow box frames and to facilitate timely fulfillment, we kindly request that corporate or tribal award orders be submitted at least two (2) weeks in advance. This lead time allows us to secure necessary materials and production prior to your specified deadline.

Individual Orders: Orders typically ship on the second or third business day after purchase. The complexity of the design influences production time also.

Bulk Orders: For purchases exceeding three original 3-D Framed Artworks, shipment will occur approximately (4) four to (6) six business days following completion of production. ​

Please note: Express Mail is not available from Bethel, so all deliveries will be sent using Priority Mail.

5. SHIPPING AND HANDLING
Each shipment is assigned a unique tracking number, allowing you to monitor the status and progress of your shipment throughout the delivery process. Shipping fees are applied at checkout and are calculated based on the flat-rate schedule established by the United States Postal Service (USPS). For original artwork, all shipments are exclusively sent via USPS Priority Mail to destinations within the United States. Please note that Express Mail services are not available through our local USPS facility.
Each artwork is inside a custom made recycled cardboard box, inside another box. A box-within-a-box protection with recycled cardboard and bubble wrap in between. The fragile stick-on signs are also reused.

We can ship anywhere in the USA at your request for shipment to another address. Tracking numbers are provided to your Electronic Mail. If you wish, we can also notify by Messenger or mobile phone text. We only use Priority Mail shipping from and within Alaska and the contiguous USA.

6. RETURN & EXCHANGE POLICY
​
For any undamaged product, simply return it with its included accessories and packaging along with the original electronic receipt (or gift receipt) within 30 days of the date you receive the purchase.

Atsaq Art accepts both defective and non-defective items for evaluation and processing. Products must be returned in new condition within 30 days of purchase.

At the buyer’s request, exchanges are available for items of equal or similar value. Any price difference will be adjusted through partial refund or additional payment.

The return address is provided inside the original packaging. Once we receive the item, please allow 7 to 14 days for refund processing.

We do not charge restocking fees.

When we receive a valid claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to customer and customer will be responsible for return shipment of the product to us.

Our Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Atsaq.Art Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof without express written contract with the Atsaq.Art having exclusive property rights and reproduction.

8. ONE-OF-A-KIND COMMISSIONS
​
Due to their originality, as never designed before, never seen before, never to be reproduced, the special "One of a Kind" orders do not qualify for discounts higher than 10%. The 10% is only applicable to the retail value at completion. One-of-a-kind commissions do not qualify for higher discounts applied to other retail items in our art galleries.

Developing Your Theme: You will be contacted for an interview just to hear your story or imagination to pick out "keyword themes," i.e., fish camp, fish net, family, summer, boating, fish, trees, birds and etc. Draft illustrations with options for your approval will be provided to determine the price range being offered by you. All characters shown on Atsaq.Art are based on templates developed by us. Your design will incorporate these templates and cost ready to achieve a flowing format of characters that best illustrates your theme.

Production: Once you approve the draft choice, production begins and progress reports with photos will be provided. These one-of-a-kind orders require more quality time, designing, sizing, flow format, color coordination and the overall impression of its originality.

Time and Cost: The cost is based on time, frame size, complexity of your design, large custom-made frames may include lumber, canvas overlay on a plywood backboard to secure masks and figurines, supplies, the number of characters, their complexity, natural materials, and the number of carvings determines the cost. Additional figurines around each mask are based on our unique style.

Mixed Media: Traditional and contemporary materials are intermixed to achieve the best impression. They may include more or less of the following natural materials such as driftwood, dentalium seashells, seal or walrus whiskers, empty crab shell, porcupine quills, clam shells, beads, sand, driftwood, goose /ptarmigan /guinea hen or turkey feathers. Paint may include, acrylic, watercolor, ink, natural iron red and copper blue traditionally used for masks and hunting implements. Natural colors are mixed with acrylic as a binding agent to enhance pigmentation and its durability.

9. REGULATED USE OF NATURAL PARTS
​
We thank our creator Ellam Yua - Jesus Christ - Person of the Universe, for these animals, fish, and birds for giving themselves. We show respect by using their parts like our ancestors in our modern-day subsistence living.
All-natural parts from living animals are acquired through legal subsistence food gathering and hunting by Alaska Natives, in accordance with the following regulations:

Migratory Bird Treaty Act of 1918 and 2017, which includes international agreements between the United States, Canada, Mexico, Japan, and Russia
​
Allowable For Natives - Feathers from migratory birds are allowable when naturally found along the coastal waters of the Bering Sea or the Yukon and Kuskokwim Delta lands inside the U.S. Fish and Wildlife Refuge, or obtained during seasonal subsistence harvests. Ptarmigan and grouse hen feathers, which are native to Alaska, are fully allowable for use under subsistence regulations.
Feathers from Eagles, Ravens, and Snowy Owls are never used due to their protected status under federal conservation laws. However, permits can be obtained from the USFWS for ceremonial purposes.

The authenticity of the artwork: Another important aspect of "safety" when it comes to Atsaq art is ensuring its authenticity and ethical origin. The Indian Arts and Crafts Act (IACA) is a truth-in-advertising law that makes it illegal to misrepresent products as American Indian or Alaska Native-made when they are not.

Authentic Atsaq art: Artist John Oscar, whose Yup'ik name is Atsa, is a known and respected Alaska Native artist. His website, Atsaq.Art, sells original and reproduction pieces that are a reflection of his heritage. Purchasing directly from his website or a reputable dealer helps ensure you are getting an authentic, ethically-sourced item.

Counterfeit art: Federal law enforcement works with organizations like the Indian Arts and Crafts Board to prosecute sellers of fraudulent Alaska Native art. When buying art from other sources, buyers should take precautions, such as:

Asking for certification: Authentic Alaska Native art may carry a "Silver Hand" symbol.

Getting written proof: Reputable sellers should provide written proof of the item's authenticity and origin.

Paying a fair price: If a price seems "too good to be true," the artwork may be counterfeit.

Migratory Bird Treaty Act and Feathers:​ Legislation supporting the regulation for the Archie Cavanaugh Migratory Bird Treaty Amendment Act was introduced to legally clarify that the sale of Alaska Native handicrafts using legally-sourced, non-edible migratory bird parts should not be criminalized under the MBTA.
For Alaska Natives, a federal regulation effective August 23, 2017, created an exception to the Migratory Bird Treaty Act (MBTA), allowing for the sale of authentic handicrafts containing feathers and other inedible parts from certain migratory birds. The birds must have been legally harvested for food during the subsistence hunting season. This was done to support the cultural and essential economic needs of Alaska Native artisans.
Key provisions:

For Alaska Natives only: This exemption applies exclusively to Alaska Natives for the purpose of creating authentic handicrafts.

Eligible bird species: The rule specifies a list of 27 bird species whose nonedible parts can be used. This list was developed to ensure that no threatened or endangered birds are used and that the sale is consistent with international treaties.

"Taken for food" requirement: The birds must have been harvested legally during the subsistence season for their nutritional needs. Artists cannot harvest birds solely for their feathers or parts.

Non-wasteful taking: The full bird must be used in a "non-wasteful" manner. All edible meat must be retained for human food.

Limited sales: Sales are restricted to within the United States (including territories). The items can be sold directly by the artisan or by consignment.

Proof of authenticity: To combat counterfeiting, items must be accompanied by a U.S. Fish and Wildlife Service (FWS) certification form or bear the state-run Silver Hand insignia.

Documentation for artisans: Eligibility for the Silver Hand program or to provide FWS certification requires an artisan to be an Alaska resident and an enrolled member of a federally recognized Alaska Native tribe.

No mass production: Handicrafts must be fashioned by hand, with only limited use of machines. Mass production is not allowed.

Permits and aquisition of feathers: To legally use feathers from a protected bird in the U.S., you must obtain a specific permit from the U.S. Fish and Wildlife Service (USFWS) under the Migratory Bird Treaty Act (MBTA) or the Bald and Golden Eagle Protection Act, depending on the species. Permits are issued for purposes like scientific collection, educational use, or religious use for Native American tribal members. You cannot apply for a permit for personal use or commercial trade of feathers.

Required for collecting bird parts, including feathers, for scientific research.

How to Obtain a Permit

10. INDEMNIFY
You agree to indemnify and hold Atsaq.Art harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your purchase(s), use of the website or any of the services offered to you from Atsaq.Art.

11. SUSPENSION​

We may temporarily suspend your access to the service without notice and liability for any reason, including if in our sole determination the respect and honor of the community and the provision of these Terms or any applicable law or regulations are violated. You may discontinue use and request to cancel your account and/or any services at any time.

To the maximum extent permitted by applicable law, Atsaq.Art its sole proprietor assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
